Article 1 - Definitions

In these General Conditions, the following terms shall be understood as:

  • Cancellation Period: The period during which the consumer can exercise their right to cancel the contract.

  • Consumer: A natural person acting outside the scope of their profession or business, who enters into a distance contract with the entrepreneur.

  • Day: A calendar day.

  • Fixed-Term Transaction: A distance contract relating to a series of products and/or services, where the delivery and/or purchase obligations are spread over time.

  • Durable Data Carrier: Any medium that allows the consumer or entrepreneur to store personal information in such a way that it can be consulted and reproduced without changes.

  • Right of Withdrawal: The consumer's ability to withdraw from the distance contract within the defined withdrawal period.

  • Entrepreneur: A natural or legal person who offers goods and/or services to the consumer through distance selling.

  • Distance Contract: A contract concluded under a system organized by the entrepreneur for the distance sale of products and/or services, where one or more means of distance communication are used until the contract is concluded.

  • Distance Communication Technique: A method used to conclude an agreement without requiring the consumer and entrepreneur to be in the same room at the same time.

  • General Conditions: The current general conditions of the entrepreneur.


Article 2 - Identity of the Entrepreneur

The entrepreneur shall provide information upon request.


Article 3 - Applicability

These general terms and conditions apply to all offers made by the entrepreneur and to all distance contracts and orders concluded between the entrepreneur and the consumer.

Before the conclusion of a distance contract, the consumer will be provided with a copy of these general terms and conditions. If this is not reasonably possible before the contract's conclusion, the entrepreneur will make the conditions available for consultation at their premises. The conditions will also be sent to the consumer free of charge upon request.

In cases where the contract is concluded by electronic means, the entrepreneur may provide the general terms and conditions electronically, ensuring the consumer can easily store them on a durable medium. If this is not feasible, it will be indicated where the general terms can be consulted electronically, and they will be sent to the consumer free of charge upon request.

If specific product or service conditions apply in addition to these general conditions, the provisions for availability and submission shall apply accordingly. In case of conflict, the consumer may invoke the provision most favorable to them.


Article 4 - The Offer

The entrepreneur may modify or adapt their offer at any time. Each offer will clearly outline the terms of acceptance, including:

  • The price, excluding any customs clearance costs and VAT on import (which are the responsibility of the consumer).

  • Shipping costs (if applicable).

  • The process and measures necessary for the contract's conclusion.

  • The terms of payment, delivery, and performance.

  • The minimum duration for fixed-term contracts.

  • Information on whether the contract is archived after its conclusion and how the consumer may access it.


Article 5 - The Contract

The contract is concluded once the consumer accepts the offer and complies with the stipulated conditions. If concluded electronically, the entrepreneur will confirm receipt of the acceptance immediately, allowing the consumer to withdraw until confirmation is received.

The entrepreneur will take necessary measures to secure electronic transactions, including ensuring a safe online environment for payment.


Article 6 - Right of Withdrawal

Consumers have the right to withdraw from a contract for goods within 14 days, starting the day after they receive the product. To exercise this right, the consumer must notify the entrepreneur in writing or via email. After notification, the consumer has 14 days to return the product.


Article 7 - Expenses in Case of Withdrawal

The consumer bears the cost of returning the product. If payment was made, the entrepreneur will reimburse the consumer within 14 days of receiving the returned product or proof of its return.


Article 8 - Exclusion of the Right of Withdrawal

Certain products may exclude the right of withdrawal, including:

  • Customized or personalized products.

  • Products that deteriorate or age quickly.

  • Sealed hygiene products or audio/video products with broken seals.


Article 9 - Price

The price of products and services may not increase during the period specified in the offer, except for price fluctuations due to market changes beyond the entrepreneur's control. Price changes are only allowed if specified in the contract or due to legal provisions.


Article 10 - Conformity and Warranty

The entrepreneur guarantees that the products comply with the agreement and applicable regulations. The entrepreneur’s warranty period corresponds to the manufacturer's warranty period, and does not cover damage caused by the consumer's misuse or third-party alterations.


Article 11 - Delivery and Execution

The entrepreneur will act diligently in processing orders and deliver products within 30 days unless otherwise agreed upon. In case of delays, the consumer will be notified and can withdraw from the contract.


Article 12 - Duration of the Contract

For fixed-term contracts, the consumer may terminate the contract at the end of the agreed period. Contracts for regular supplies of products or services can be terminated with a one-month notice, with specific rules for renewal and termination provided.


Article 13 - Payment

Payments are due within 7 working days from the cooling-off period, unless otherwise agreed. The consumer must immediately notify the entrepreneur of any inaccuracies in payment information.


Article 14 - Claims

Complaints must be submitted within 7 days of discovering defects. The entrepreneur will address complaints within 14 days and offer either a repair or replacement if the claim is justified.


Article 15 - Disputes

Contracts between the entrepreneur and the consumer are governed by Thai law, even if the consumer resides abroad.
